Conversion from term to indeterminate
Management confirmed that term-to-indeterminate conversions are not resuming at this time. While no timeline was provided, discussions with management are ongoing in the context of current fiscal constraints.
Term extensions
Term extensions continue to be assessed based on operational needs and available funding, with approval required beyond the immediate manager. While extensions are reviewed more carefully, they remain possible where justified. Term contracts may end early in certain circumstances, in accordance with notice requirements.
Process for obtaining approval of a term LP extension
- Prior to sending a request to HR, the hiring manager must first verify the instrument of delegation to confirm who can approve a term extension and obtain that approval in writing.
- Depending on the approval process, the hiring manager would usually need to provide details and justifications to the delegated manager. Managers may have a checklist to follow, but HR definitely has one that requires the delegated manager’s written approval to proceed with a term extension. We do not have a copy of that checklist.
- If the hiring manager is the delegated authority, they may submit the request directly to HR. However, if a staffing freeze is in effect, the request won’t be actioned.
LP-01 program
The LP-01 program remains paused. No restart date was confirmed, and the situation continues to be monitored.
Employment conditions and benefits for term employees
Term LPs are not eligible for Employment Insurance at the end of a contract. Maternity and parental leave remain available within the duration of a term. Bonus eligibility depends on meeting performance requirements and being employed at the relevant assessment date.
Programs and mobility opportunities
Mobility and alternation programs currently apply to indeterminate employees. The alternation list cannot be expanded to term employees because only indeterminate employees are eligible under the WFA Directive to participate in alternation. At this time, there are no equivalent programs specifically for term employees.
Under the Mobility initiative, positions will be filled through voluntary at-level deployments. A deployment is a transfer from one position to another and is not an appointment. It does not constitute a promotion and does not change an employee’s status from term to indeterminate. As such, an at-level deployment does not convert a term position into an indeterminate one.
However, nothing prevents term employees from applying for positions. We encourage term members to contact mobilite.mobility@cfp--sc.gc.ca to confirm whether they may apply and to ask whether a term extension could be considered.
Articling students
Rehiring decisions for articling students are made on a case-by-case basis, depending on operational needs and available funding. Situations involving rescinded indeterminate offers were acknowledged, and affected individuals were encouraged to connect with the union for support.
Grievances and recourse
The union continues to pursue grievances and advocacy on these issues. Outcomes depend on individual circumstances, and members are encouraged to seek guidance as needed.
